Can a disability keep a tenant from getting evicted?

A: By law a private landlord must not discriminate against a tenant no matter their race, sex, religion or disability. Meaning should  they refuse to make reasonable changes to their property or a term in their tenancy agreement, which will enable you as a disabled individual to live there, they are in fact breaking the law. This can include refusing to remove their no pets ban to enable you to keep a hearing dog or failing to install a lift or adapt the bathroom...

However, if you have genuinely broken a term in their assured tenancy agreement (falling into rent arrears, damaging the property, taking illegal substances etc), which is unrelated to your disability; if you have done nothing to amend it, unfortunately this cannot keep you from being evicted.

My advice would be, before you sign a tenancy agreement that you sit down with your landlord and list your requirements as a tenant. For instance, what they can do to make paying your rent easier. This should be accompanied by a solicitor who can agree to introduce clauses to the tenancy that can protect both your interests.
