Q: Can I refuse to pay rent for the period I was without heating?

Despite informing my landlord straight away about my combi boiler not working (meaning me and my partner had no hot water or central heating for 5 days), he refuses to pay for a plumber and has said he will come round to fix it himself. Can I refuse to not pay rent for the period we have been without hot water and heating?

A:

As a landlord it is his responsibility to ensure that your boiler is in working order and is providing hot water and heating (under the stature of section 11 of the Landlord & Tenant Act 1985). This means he should attend to the problem within a reasonable amount of time, once he has been notified of the problem.

I am guessing from the fact that he is coming to repair the boiler himself that the issue may be something simple such as changing the water pressure on your boiler. If this is the case, then he should have showed you how to bring the water pressure up to the required level when you first moved into the property let.

Now in regards to your rent, I advise against not paying your rent for the period you are without heating as this can trigger rental arrears. However, you could try negotiating a reduction in your rent for this period as legally he is responsible for resolving this issue within a reasonable amount of time.
