Q: Non Paying Tenant Refusing Contact
My tenant has not paid his rent for months but refuses to talk to me
A: This
can happen with tenants from time to time, especially if you are trying
to contact them by phone or in person. The best form of contact is
through written documentation which you can send by special delivery.
This will one, enable you to prove at a later date that you have been
in contact your tenant about their rent arrears (as the date on the
special delivery will act as a testament that it was sent). And two,
this will help your case should you choose to evict your tenant (the
letter will show that you have done everything in your power to work
with your tenant to collect this rent).
If you haven't already sent your tenant a Rent Arrears Letter,
I suggest you do so immediately. This letter can be used to highlight
the rent outstanding and when the rent is expected. However, it is
important to note that if your tenant fails to pay their rent for over
2 months, it is within your legal right to issue them with a Section 8 that will allow you to begin eviction proceedings.
