Q: Dealing with rent when unemployed

In August I entered into a 6 month tenancy agreement with my landlord. A month after I began renting the property I was made unemployed and was no longer able to afford the rent. I wrote to my landlord requesting the property be re-advertised and that I would cover any costs to do this. My landlord agreed, but it has been 2 months and there has been no interest.

Under my tenancy agreement I have to give 2 months notice to end my tenancy, but I can't do this until January. Does this mean I am liable to pay rent until March?

A:

I’m afraid unless there is a break clause in your assured shorthold tenancy agreement, then you will be liable to continue paying this rent under this agreement.

I recommend checking to see if your tenancy agreement contains this break clause, as this will allow you to end your tenancy early. However, if this is not the case, I strongly advise trying to find a replacement tenant yourself. Should you do this and pay the advertising costs, then your landlord will be expected to re-let the property to this new tenant and let you go.

Now should he/she then fail to do this, you can then defend any claim they make about unpaid rent as they will have failed to cover their losses by not using the replacement tenant you found.
