How long does a tenant have to leave your property let at the end of a lease?
A: If you are not planning to renew your tenants assured shorthold tenancy agreement, it is important that 3 months prior to the ending of their agreement that you give your tenant written notice of your intention to apply to the court for possession. If your tenant does not leave by the time this 3 month notice ends, then you can apply to the court for possession.
Similarly, it is also important to remember that 1) you need to stick to this 3 months notice period and as such send this letter 3 months before the end of their tenancy and 2) you send this written notice by recorded delivery to ensure that your tenant receives it (NOTE: accommodate for delivery time when setting your notice period and begin it from the day they receive the letter).
Take this scenario for instance:
Should you send this letter when they have only got 2 months remaining on their tenancy, you have essentially given them an extra month in your property let, before they have to legally leave. So if their tenancy is set to end on the 31st July, aim to serve this notice no later than the 1st May.
